Effective Date: January 1, 2025
At TikTop, we recognize the importance of intellectual property in the digital age. Creators spend hours, days, and sometimes weeks crafting content, and they deserve to have their rights respected. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable international intellectual property laws, we have established the following policy to address copyright infringement claims clearly and effectively.
This document serves to explain the nature of our service, our liability limitations as a service provider, and the strict procedure for reporting potential infringements. By using our website, users acknowledge that they have read, understood, and agreed to the terms outlined herein.
It is crucial to understand exactly how TikTop operates technically before filing a complaint. TikTop acts solely as a Service Provider as defined in 17 U.S.C. § 512(k)(1). Our website is a tool that facilitates the downloading of media from public URLs provided by the user.
TikTop does not host, store, cache, or archive any videos, images, or audio files on our servers. When a user inputs a URL from a platform like TikTok, Instagram, or Facebook, our script simply locates the source file on that platform's own Content Delivery Network (CDN) and streams the data directly to the user's device. We do not have a database of videos, and we do not "own" the content.
Because we do not host content, we do not have the ability to "delete" a video from the internet. If a video is deleted from the original platform (e.g., if TikTok removes a video), it will immediately become inaccessible through our tool as well. Therefore, the most effective way to remove infringing content is to contact the host platform directly.
TikTop is provided as a tool for personal archiving and fair use purposes. Users are responsible for their own actions. We strictly prohibit the use of our tool for copyright infringement. When you use TikTop, you agree that:
If you are a copyright owner, or an agent authorized to act on behalf of one, and you believe that your copyrighted work has been improperly accessed or linked to via our service, you may submit a Notification of Claimed Infringement. While we do not host the files, we can block specific URLs from being processed by our service.
To be effective, your notification must be in writing and include the following substantial information (please consult your legal counsel or see Section 512(c)(3) of the DMCA to confirm these requirements):
Please provide a detailed description of the copyrighted work you claim has been infringed. If multiple works are involved, a representative list of such works is required. This helps us verify that you are the legitimate owner.
You must provide the specific location (URL) of the material that you claim is infringing. Since we do not host content, saying "the video of the dancing cat" is not enough. We need the exact URL that users are pasting into our input box (e.g., https://www.tiktok.com/@user/video/123456789).
Provide your full name, mailing address, telephone number, and an email address where we can contact you regarding your complaint.
You must include a statement that you have a "good faith belief" that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please send all DMCA Notices to:
Email: legal-support@tiktop.online (or use our Contact Form).
If you believe that access to a URL was disabled by mistake or misidentification, you may file a counter-notification with us. This is often relevant if you have a license to use the content or if the content falls under fair use.
Your counter-notification must include:
In accordance with the DMCA and other applicable law, TikTop has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. Since we do not require user accounts to use our basic features, we implement this by banning IP addresses. If we determine that a specific IP address is continuously generating infringing download requests or abusing our service to scrape copyrighted content effectively, we will permanently ban that IP address from accessing our servers.
We do not support or encourage the circumvention of technological measures that control access to copyrighted works. If a platform (like Netflix or specific paid content sites) uses DRM (Digital Rights Management) or encryption to protect content, TikTop will not process those URLs. Our tool is designed strictly for public, unencrypted social media content.
TikTop reserves the right to modify, alter, or update this Copyright Policy at any time. We encourage you to review this page periodically for any changes. Your continued use of the website following the posting of changes to these terms will mean you accept those changes.
For any further questions regarding this policy or to report a violation, please contact us immediately.
